01 · What this website is
Smart Pine Harbor presents a small coastal stay concept: room styles, a kitchen that follows the day's catch, a clay studio and a few outdoor outings. This website exists to give information and to receive enquiries. By using it you agree to these terms. They are written to be read, so we have kept them short and plain where we could.
02 · No online booking
There is no booking system on this website. The forms open a draft in your own mail program, and sending the draft is an enquiry and not a reservation. A stay, a meal, a session or an outing exists only when we have confirmed it to you in writing and you have accepted that confirmation. Until then, either side may decide not to go ahead without any liability.
03 · Prices and availability
This site does not publish a price list. Rates, what is included, taxes and dates are given in our reply to each enquiry and are valid only for the stay described in it. We may change a quote until it is confirmed in writing, and anything you read elsewhere on this site, including in articles, is a description and not an offer.
04 · Permits and regulated services
Lodging, serving food, carrying passengers on a boat and describing a bath as a hot spring are all regulated in Japan, and each needs the permits or registrations that apply. This website does not claim any of them. Whether an element of a stay can be arranged, by us or by a local operator who holds the proper permits, and the status of those permits, is told to you on request and before anything is confirmed. If an element cannot lawfully be provided, we say so and do not offer it.
05 · Descriptions and photographs
The text describes how the stay is planned. Some details, such as the number and style of rooms, the menu or the route of a walk, may change, and the photographs are illustrative images of coast, light and clay and not pictures of a finished property. When something matters to your decision, ask us in your enquiry and we will answer in writing.
06 · Health, safety and conditions
Nothing on this site is medical, nutritional or safety advice. Walks, sea mornings, baths and clay work involve ordinary physical risks: uneven paths, cold water, hot water, slippery surfaces and weather that changes quickly. You are responsible for judging whether an activity suits you and the people with you, for following instructions given on the day, and for supervising children. Tell us before you decide if you have a condition that affects what you can do.
07 · Content and ownership
The text, the layout and the images on this site belong to Smart Pine Harbor or are used with permission, unless another source is named. You may read and share links to it. You may not copy it for another website or for a commercial use without our written consent.
08 · What you send us
You are responsible for the accuracy of what you send. Please do not send anything unlawful, abusive or belonging to somebody else. We handle what you send as described in the privacy policy.
09 · Links to other sites
If this site links to another website, we do not control it and are not responsible for what it says or does. A link is not an endorsement.
10 · Limits of responsibility
We try to keep this site accurate, but we cannot promise that it is complete or free of mistakes, or that it will always be available. To the extent the law allows, Smart Pine Harbor is not responsible for loss caused by relying on a general description on this site instead of a written confirmation, or by a failure of your mail program or provider. This does not limit any liability that cannot be limited by law, including consumer rights you hold under Japanese law.
11 · Changes to these terms
We may change these terms when the site or the law changes. The date at the top of the page shows when they were last updated, and a change applies from that date to your later use of the site.
12 · Governing law and courts
These terms are governed by the law of Japan. If a dispute cannot be settled by talking, the court that has jurisdiction over Kure, Hiroshima, where our registered office is, is the court of first instance, without limiting any mandatory right you may have to bring a claim in another court.
